    Riverton woman charged with DUI while children were in the vehicle

    On April 20th, the Riverton Police Department were dispatched to Jaycee Park on Sunset Drive for a report of a passenger car driving around the parking lot with, “children hanging out the back window, that was broken out.”

    An RPD officer observed the vehicle leaving Jaycee Park and traveling east on the 1700 block of West Sunset. The officer noted in court documents seeing a child hanging out the broken back window. The officer then initiated a traffic stop.

    The driver identified herself as 36-year-old Krystal Miller. Miller was traveling with two adult passengers and three unrestrained small children in the back seat.

    The officer noted in court documents smelling a strong odor of alcohol coming from Miller’s breath and that her speech was slurred. Miller advised the officer while she was at the park that she had consumed five mixed alcoholic beverages.

    A field sobriety test was failed and a breath sample gave a reading of a .178% breath alcohol content level.

    Miller was arrested and charged with 3 counts of Driving Under The Influence of Alcohol with Children In The Vehicle. If convicted, the penalties could carry an enhanced charge because Miller was convicted of a DUI in 2016. Each of the three counts are punishable by up to 5 years of imprisonment.

    Additionally, Miller was charged with not having a proper child safety restraint system, punishable by a fine of up to $50. She is also charged with driving with a revoked license, punishable by up to 6 months of imprisonment and a fine of up to $750.

    On April 30th, Miller waived her preliminary hearing. It will be transferred to District Court for further proceedings and arraignment at a later date.

    All suspects are innocent until proven guilty in a court of law.
