    Riverton man arrested on 3rd battery charge after headbutting girlfriend

    A 35-year-old Riverton man is being accused of his 3rd battery charge in less than 7 years.

    On February 10th Riverton Police Officers responded to a call about a fight inside of a residence.

    A man identified as Emery Tindall told officers he was in an argument with his girlfriend. He told officers he was walking out of the bathroom when he, “collided heads” with his girlfriend. RPD officers noted in court documents, they believed Tindall to be intoxicated with, “slurred speech and a strong smell of alcohol.”

    Officers recorded the man’s girlfriend had a “noticeable head injury.” She told RPD that she had been, “headbutted” after the couple had been involved in an argument about, “the past.”

    She told RPD she was close to, “blacking out” after the headbutt. She was treated for injuries at SageWest Riverton.

    A record check revealed that Tindall had two previous battery charges in 2012.

    3 charges in a span under 10 years qualifies for a possible enhanced penalty. He is currently facing one count of “Domestic Battery – 3rd or Subsequent Offense.” The charge is punishable by up to 10 years of imprisonment and a fine of up to $10,000.

    On February 28th, Tindall waived his preliminary hearing. It will be transferred to District Court at a later date.

    All suspects are innocent until proven guilty in a court of law.
