    23-year-old Fremont County resident facing three counts

    All suspects are innocent until proven guilty in a court of law.

    Brian Jeffery, 23, of Fremont County, is facing one count burglary, one count theft and one count endangering children-encouraging a minor to commit violation of law.

    Charges are related to an event that took place on October 15th, 2018 in Lander. Jeffery waived his preliminary hearing on August 20th, 2019. The case is being transferred to District Court for arraignment.

    Court documents describe the Lander Police Department being dispatched to Tony’s Pizza for a possible burglary at approximately 7:25 am on Tuesday, October 16th, 2018. The responding officer reported the cash register had been opened, the ATM had been tampered with and the main business office appeared to have been “ransacked.” It is also reported “the back door had its glass broken by some form of blunt force.”

    LPD was later dispatched to Thai Chef at approximately 10:59 am on October 16th, 2018, for the report of a theft. The responding officer “…observed the cash register to be open…” It is reported the doors were locked and the officer did not “observe any pry marks or indications that someone attempted to gain entry.” The responding officer was informed on the scene that Jeffery has keys to the business.

    While at the Lander Police Department on October 17th, 2018, Jeffery allegedly said, “…he was the one who stole the money from the business.” Jeffery also reported “smoking a lot of ‘pot’ the past week and was helping several people get ‘weed’ from people around town…he did not have any money and needed to get some.”

    Court documents note Jeffery and a juvenile traveled together to Thai Chef at around 10:15 pm on Monday, October 15th. Jeffery allegedly “told the juvenile to remain outside while he entered the business.” It is reported Jeffery unlocked the front door, entered the building, took cash from the register, unlocked the back door and re-locked the front door when exiting. Jeffery and the juvenile then drove away.

    Court documents state Jeffery reported, “while he was walking to his dealer’s house, he heard a loud crash.” Returning to his car he witnessed the juvenile with a torque wrench in hand and saw the back door to Tony’s Pizza broken. Jeffery allegedly claimed he did not go into Tony’s and “he did not see if the juvenile took anything…”

    An interview with the juvenile was conducted by LPD on October 18th, 2018. The juvenile allegedly shared Jeffery retrieved the torque wrench from his vehicle which was used to hit the glass on the back door of Tony’s Pizza twice. According to this interview, both entered into Tony’s Pizza. No money was found but the juvenile admitted to taking a speaker that they later gave to Jeffery. “…they left after a few minutes of not finding any money.”

    It is reported LPD confronted Jeffery later in the day on October 18th about the information the juvenile provided. Jeffery allegedly stated, “he had lied to me about not being involved.” Jeffery confirmed they went to get more money at Tony’s Pizza after leaving Thai Chef. No money was found but a portable speaker was taken.

    Jeffery is being charged with:

    • One count burglary (felony) with a maximum penalty of imprisonment for no more than 10 years, a fine of no more than $10,000 or both.
    • One county theft (misdemeanor) with a maximum penalty of imprisonment for no more than 6 months, a fine of no more than $750.00 or both.
    • One count endangering children – encouraging minor to commit violation of law (misdemeanor) with a maximum penalty of imprisonment for no more than 1 year, a fine of no more than $1,000 or both.
